Emigration Contract -- DOBSON Family -- Contrato de Colonización

Mr. Nicolas Vega Agent in Europe of the Chilian Government for Colonization, acting as representative of his Government, and Mr. David Dobson, agriculturist, a subject of Great Britain, have agreed as follows:
Article 1.- Mr. David Dobson shall go to Chili as a colonist, taking with him his family, as mentioned in the above table, to settle in the Province of Chiloé, at the place which shall be allotted to him by the Inspector General of Colonization, or by the official acting on his behalf.
Article 2.- The Chilean government pledges itself to Mr. David Dobson:
A. To furnish him at the port of Liverpool a third class passenger ticket to Chili, for himself and for every member of his family as described above, at the rate of:
Fr. 250 per adult;
" 125 for every child from 8 to 12 years;
" 62.5 for every child under 8 years;
(one child under 3 years for every family is transported free)Making a total of One thousand six hundred and eighty seven francs 50/100 (frs 1.687,50) with the right of transport of 675 kilos luggage free. Any excess over the above amount shall be paid by the colonist to the Steamship Company at the port of embarcation, at the rate of 40 francs per hundred kilos.
B. To transport him, his family and his luggage gratis, from the port of landing to the Colony.
C. To remit him thirty centavos per day for every adult and fifteen centavos for every son or daughter over the age of ten years, from the day of his landing in Chili, until the day when he shall have been put in possession of the lot assigned to him.
D. To provide him with a pair of oxen and a gear for field or road, an American plough, a cart, 150 planks, one inch thick, 9 inches wide and 13 ½ feet long, and 23 kilos of nails; all valued at the current price at the time of delivery.
E. To grant him 70 hectares of land, plus 30 hectares for each of his male children who are at least 12 years old: Isaac 30 hectares; John 30 hectares; William 30 hect; making a total of One hundred and sixty hectares. The boundaries of the grant shall be well defined by pathways on the hill-sides, by stakes at the corners and at every 200 yards along the main lines.
F. To give him, for one year, a monthly allowance of twenty pesos, so as to provide for his immediate wants.
G. To provide, in case of grant contains wooded land, an uprooting machine for every twenty families, each family using it in turn, as shall be decided by the Director of the Colony.
H. To furnish him, gratis, medical assistance and medicine, during the first two years of his settlement in the Colony.
Article 3.- On his part Mr. David Dobson pledges himself, on his honour and under guarantee of the property which he takes with him to Chili, or which he may acquire hereafter:
1. To settle for at least six years on the lot assigned to him, to work it personally and, during that time, not to leave the settlement without permission from the Director of the Colony.
2. To repay the loans made to him, both in money and kind, by the Chilian Government, mentioned in paragraphs A, C, D and F of article 2. This repayment is to be effected by five instalments, each equal to one fifth of the amount and payable from the fourth year of his settling on the land, so that the first instalment shall be paid at the beginning of the fourth year, and the others at the commencement of each succeeding year after the first payment.
3. Not to alienate any of the objects of labour which he has received, unless he has, by the authorization of the Director of the Colony replaced them by similar ones.
4. Not to alienate his land, nor promise to sell it, nor bind himself by any contract which may deprive him of his free possession, or hinder him in its cultivation, before he has received the title-deeds from the Chilian Government, conferring upon him the full property of his holding.
5. To observe the regulations issued by the Government to maintain order in the Colony.
Article 4.- The Chilian Government will deliver the title-deeds of ownership when the colonist shall have occupied and worked his grant for six years and when, by a report of the Inspector General of the Colonies, it is proved that he has fulfilled the obligations mentioned in the present contract.
Article 5.- As a guarantee for the two last instalments of one fifth each, or for what the colonist may still owe to the State when he claims his title-deeds, the land will remain under mortgage till the debt be completely paid off.
Article 6.- If Mr. David Dobson should not fulfil any and every of the above mentioned obligations, the present contract shall be cancelled, without the Chilean Government being held or expose to any indemnity. If this contract should be cancelled by the Government, or if David Dobson should not fulfil it before he has paid the instalments as above mentioned in paragraph 2 of article 3, he, the colonist, shall be compelled to refund at once the amount which shall still be due to the state. Should he not comply with this, or should he leave his grant clandestinely, he will be prosecuted according to the law.
Article 7.- Any emigrant, found at the moment of embarcation to be suffering from some serious or contagious illness, will not be accepted; and the present contract shall be cancelled of right, should Mr. David Dobson, or his wife be thus affected.
Made in three copies, and in conformity with the Chilean law, which shall govern this contract.

Entre Don Nicolás Vega Agente de colonización del gobierno de Chile en Europa, en representación de su Gobierno, y el señor David Dobson, agricultor, ciudadano inglés se ha celebrado el siguiente contrato:
Articulo 1.- El señor David Dobson se traslada á Chile en calidad de colono, acompañado de su familia, compuesta de las personas indicadas en el cuadro preinserto, para establecerse en el lugar de la provincia de Chiloé que le designe el inspector general de colonización ó quien haga sus veces.
Articulo 2.- El gobierno de Chile se compromete para con el señor David Dobson:
A. A entregarle en el puerto de Liverpool un boleto de pasaje de tercera clase hasta Chile para él y cada una de las personas que componen su familia enumerada mas arriba. Los pasajes se dan á razón de:
Fr. 250 por adulto.
Fr. 125 por cada niño de 8 á 12 años.
Fr. 62.5 por cada niño menor de 8 años.
(Un niño menor de 3 años es transportado gratuitamente)lo que suma mil seiscientos ochenta y siete francos 50 centecimos (frs 1.687,50) con derecho al transporte gratuito de 675 kilos en equipaje. Si lleva equipaje de mas peso ó volúmen, el colono deberá abonar su costo á la Compañía de vapores en el puerto de embarque á razon de 40 francos los 100 kilos.
B. A conducirlo gratuitamente á él, su familia y equipajes desde el puerto de embarque a la colonia.
C. A darle treinta centavos diarios por adulto y quince por cada hijo ó hija mayor de 10 años desde el día de su llegada á Chile hasta aquel en que se le dé posesión de la hijuela ó terreno que se le ha destinado.
D. A suministrarle una yunta de bueyes, un yugo arador ó carretero, un arado americano, una carreta de madera, 150 tablas de una pulgada por nueve pulgadas y 4 ½ varas de largo y 23 kilógramos de clavos, el todo evaluado al precio corriente de costo á la época de la entrega.
E. A entregarle un lote de terreno de 70 hectáreas por sí y 30 hectáreas por cada uno de los hijos varones mayores de doce años. Isaac: 30 hect; John: 30 hect; Williams: 30 hect. Lo que hace un total de ciento sesenta hectáreas, bien deslindadas, con sendas abiertas en la montaña ó con estacas en las esquinas y cada 200 metros en las lineas principales.
F. A pagarle una pension de veinte pesos mensuales durante un año, para su sostenimiento.
G. A suministrar una máquina destroncadora para cada veinte familias, que usarán por turno, según lo establezca el director de la colonia, cuando la hijuela sea con bosque.
H. A suministrarle asistencia gratuita de médico y medicinas durante los dos primeros años de su instalación en la colonia.
Articulo 3.- El señor David Dobson á su vez se compromete bajo fe de su palabra y obligando los bienes que transporte á Chile ó los que pueda obtener:
1. A establecerse con su familia en la hijuela que se le designe y á trabajarla personalmente durante seis años á lo ménos. Durante este tiempo no podrá ausentarse de la colonia sin permiso del director de ella.
2. A devolver los adelantos que en dinero ó en especies hubiera recibido del Gobierno de Chile, indicados en los incisos A, B, C, D, F del artículo 2. Este reembolso se verificará en cinco anualidades, cada una de una quinta parte del total de la deuda, pagaderas desde el cuarto año de la fecha de establecimiento del colono. Así la primera cuota deberá pagarla al principio del cuarto año y las siguientes en cada año después de este primer pago.
3. A no enagenar ninguno de los objetos que ha recibido para el trabajo sino cuando los reponga por otros análogos, y esto con permiso del director de la colonia.
4. A no enagenar su terreno, ni hacer sobre él promesa de venta ó contrato alguno que lo prive de su libre tenencia y cultivo, mientras no reciba del supremo Gobierno de Chile el titulo definitivo de propiedad que le transfiera en absoluto su dominio.
5. A respetar el reglamento de la colonia y las medidas que se dicten para su mejor gobierno.
Articulo 4. - El Gobierno de Chile extenderá el título definitivo de propiedad despúes que cada colono haya permanecido seis años en posesión y cultivo de su predio y acreditado con un informe de la Inspección General que ha cumplido con las obligaciones que le impone este contrato.
Articulo 5.- Para responder por las dos anualidades de una quinta parte ó por lo que el colono quede adeudando al Estado cuando solicite título definitivo quedara hipotecado el predio concedido, hasta que se cancele totalmente lo que adeuda.
Articulo 6.- La falta de cumplimiento por parte del señor David Dobson de cada una de estas obligaciones importara la resolución del contrato, sin perjuicio alguno para el Gobierno de Chile. Si este contrato se cancelara por el Gobierno ó se dejara sin efecto por el señor David Dobson antes de haber cubierto las anualidades de que habla el No. 2 del artículo 3, éste queda obligado á devolver las sumas recibidas de una sola vez. En caso de no hacerlo ó de abandonar furtivamente el terreno, será perseguido conforme á la ley.
Articulo 7.- Todo emigrante que al embarcarse sufriere enfermedad grave ó contagiosa será rechazado, y el presente contrato quedará resuelto de derecho si el señor David Dobson ó su mujer se hallaren en este caso.
Hecho por triplicado y con arreglo á las leyes chilenas que le rigen.
